Chapter five: Taqsīr

It is the fifth obligation of ‘umrah.
Issue 313. TaqsÄ«r is obligatory after finishing sa‘y. It means cutting some of the hair on the scalp, beard or mustache or cutting some of the hands or feet nails.
Issue 314. Taqsīr is a worshipful ritual for which intention is obligatory with the conditions mentioned in the intention for iḥrām.

Issue 315. To have one's head completely shaved is invalid as an alternative to taqsÄ«r to get free from the ihÌ£rām of ‘umrah of tamattu‘, i.e. taqsÄ«r is obligatory. Then if one had shaved before taqsÄ«r, he must do kaffārah with a sheep if he had done it deliberately and consciously. But, if one is in ihram of `umrah al-mufradah, he has the choice to have a shave or do taqsir.
Issue 316. Plucking the hair is invalid as an alternative to get free from the ihÌ£rām of ‘umrah of tamattu‘ i.e. taqsÄ«r is obligatory. If one had done so, it would be invalid and they must do the kaffārah of plucking if they had done it deliberately and consciously.
Issue 317. If one who was ignorant of the ruling plucked his / her hair instead of taqsÄ«r then he / she performed hajj, his / her ‘umrah is void and the performed hajj will shift to ifrād. Then if his / her hajj is obligatory, it is based on obligatory caution to perform ‘umrah al-mufradah after its rites and then to perform ‘umrah of tamattu‘ and hajj the next year. The rule is the same for someone who shaved his hair out of ignorance.
Issue 318. It is not obligatory to hasten to do taqsÄ«r directly after sa‘y.
Issue 319. If one deliberately or ignorantly neglected taqsÄ«r and did ihÌ£rām for hajj, it is more likely that his / her ‘umrah would be void and his / her hajj would be changed to ifrad, and it is based on obligatory caution to perform ‘umrah al-mufradah afterward and repeat the ‘umrah and hajj the next year if hajj is obligatory for him / her.
Issue 320. If one inattentively neglected taqsÄ«r and did ihÌ£rām for hajj, his / her ihÌ£rām would be correct and so would be his / her ‘umrah and hajj, and there is nothing else required. However, it is mustahÌ£abb for them to do kaffārah with a sheep. More than that it is, better according to caution, not to neglect this kaffārah.
Issue 321. After taqsÄ«r of ‘umrah of tamattu‘ every thing which was hÌ£arām for someone during ihram, becomes hÌ£alāl even women.
Issue 322. Tawāf al-nisa' in ‘umrah of tamattu‘ is not obligatory; however, according to caution, it is better to perform it with its prayer with the hope of being required. While if a man had done ihÌ£rām for ‘umrah al-mufradah, women would not become hÌ£alāl for him until after doing tawāf al-nisa' and its prayer after the taqsÄ«r or hÌ£alq. The manner and rulings of tawāf al-nisa' are the same with that of ‘umrah.
Issue 323. Apparently, for each ‘umrah al-mufradah and hajj there must be a separate tawāf al-nisal', e.g. if one performs two ‘umrah al-mufradahs or a hajj with an ‘umrah al-mufradah, it is obligatory for each to perform a separate tawāf al-nisa'. However, it is not remote that women may become hÌ£alāl after one common tawāf al-nisa'.
