Chapter Six: Taqsir or Halq
Issue 357. After slaughtering hady it is obligatory to do ḥalq (shaving of the head) or taqsīr (to cut some of the hair or nails). Taqsirr is strictly obligatory for women for whom ḥalq only is invalid and it is based on caution for them to combine cutting some of the hair and nails. For men, and according to caution, ḥalq is obligatory in case he is performing hajj for the first time; otherwise he is free to do ḥalq or taqsīr.
Issue 358. Both ḥalq and taqsīr are worships for which intention is obligatory which must be free of hypocrisy and to intend obedience to Allah the Sublime. Then if one does ḥalq or taqsīr without the said intention, he / she would not be released from ihram or allowed to do things doing which is dependent on halq or taqsir.
Issue 359. If one is helped in doing taqsīr or ḥalq by another person, he / she must do intention by himself / herself.
Issue 360. It is based on obligatory caution to do hÌ£alq or taqsÄ«r during the day of ‘Ä«d; otherwise if one does not, he / she must do them the night before the 11th day or later on and it would be valid.
Issue 361. For someone who had delayed the slaughtering after the day of ‘Ä«d for some reason, it is not obligatory during them to delay hÌ£alq or taqsÄ«r. More than that it is not remote that doing it is obligatory for the day of ‘Ä«d for which caution is not to be neglected, while performing the tawÄf of hajj and the other 5 practices of Mecca – in this case - before slaughtering is a matter of doubt.
Issue 362. In normal conditions hÌ£alq or taqsÄ«r must be done at MinÄ and no other place.
Issue 363. If one, deliberately, forgetfully or ignorantly, hÌ£alq or taqsÄ«r outside MinÄ and then performs the other practices, he / she must return to MinÄ for it and repeat the other dependent practices. The rule is the same if one has neglected them and left MinÄ.
Issue 364. On the day of ‘Ä«d it is obligatory first to do ramy of Jamarah al-‘Aqabah, slaughtering hady — i.e. if one is able to do it on this day at MinÄ — and then taqsÄ«r or hÌ£alq. If one deliberately disturbed this succession, he / she would be disobedient, although apparently it is not obligatory to repeat them in succession. Nevertheless if one could, repetition goes with caution. The rule is the same in case of ignorance and forgetfulness. However, if one is not able to slaughter hady at Mina' on the day of ‘Ä«d, then if he / she could do it on that day in the slaughter-house present nowadays outside MinÄ, it is based on obligatory caution also to slaughter the hady before the hÌ£alq or taqsÄ«r. While if this also is impossible, it is based on obligatory caution to do hÌ£alq or taqsÄ«r on the day of ‘Ä«d and get free of ihÌ£rÄm but to delay the practices of Mecca after slaughtering the hady.
Issue 365. After hÌ£alq or taqsÄ«r the muhÌ£rim becomes free to do or enjoy everything that was hÌ£arÄm for him / her during ihÌ£rÄm except women and using perfume.
